What’s good for the goose is good for the gander! The cat was out of the bag when LE allowed Tom to view the evidence. Since he didn’t recognize anything new IIRC, why not now release to the public or to his website so all those who have followed can see what there is there. It just may be that something will jump out at someone in that pile of correspondence that will be what’s needed to jog memories.

I know I’m falling for your trap, Tom, but I can’t help myself. Law enforcement officials can do whatever they with the physical items they deem as evidence. They can throw it into San Francisco Bay. They can take it home, slatter it in butter and fry it, if they want. However, if there is no clear chain of custody then there is an inference of spoliation. On none of the videos I watched did I see where you sogned any logs or sealed any evidence with your initials. So, if I demonstrated that the evidence was not properly handled by you, then there is an inference that it was not properly handled by someone else also–someone with perhaps nefarious motives. This is one of MANY things that are wrong from a legal-evdentiary standpoint about allowing a civilian to handle evidence. Again, that’s not a problem if the intend is to solve the case and not necessarily with putting somebody in prison.

Tom, what you fail to recognize is I AM ON YOUR SIDE in this matter. Please re-read my post and try to understand it before you mischaracterize what I said. I never said what you claimed I said. Or, instead of re-reading, just keep attacking the people who try to defend you.

The source of the hopeful DNA isn’t even in california at least to my understanding it’s interstate.

Also, the lab is not LE but that hasn’t helped any other quacks clients.

I imagine that none of the employees of the laboratory have publicly named their favorite suspects in this case. If a living suspect’s DNA is found on any items handled by (or even in the immediate presence of) a famous blogger/webmaster/Z enthusiast, then a good lawyer coule make a strong case that there was secondary, tertiary, quaternary, etc. transfer. Or, maybe even primary transfer by someone trying to drive traffic to a website. Anyone who has an interest in a case, whether pecuniary or otherwise, should not be allowed to be in close proximity to evidence in that case.

Think of it this way: when Phil Vannater took a vial of OJ’s blood home to Simi Valley instead of to the evidence room, he opened himself up to an accusation that he planted evidence. Even if Vannater had NO ill intentions, and even if he did nothing nefarious, he still left himself open to that accusation. Likewise, a civilian who has an interest in a case leaves himself open to accusations of planting evidence even if he did nothing wrong. So, that evidence becomes meaningless if it is used to connect the defendant to a crime.

HOWEVER, as a reminder, I still believe it’s a good thing that law enforcement allowed Tom to view the evidence. I wish they would open jt up to all of us. But, the evidence is not going to be useful in a trial now. Rsther, it’s the next series of pieces of evidence that would be used to convict a living suspect.
