Are you sure his hair color was brown?
It does look black but I believe the consensus is that was a dye-job, since other photos indicate he had brown or reddish-brown hair. An issue though might be his ears sticking out enough with a crewcut that that feature would be noted by the witnesses, which it wasn’t.
