This is incredible evidence, however, Ken never had a trial, DNA alone is not normally enough in court, and law enforcement did not use Codis, they used a family tree matching/private database, which is unethical, The more law enforcement utilizes private DNA databases, the less people will utilize these sevices, the major private DNA database companies have already stated this on more than ine occasion, and these places will mostly like go out of business.

Am I the only one who has a problem with a Sheriff calling someone a murderer without a trial?

I think just the paranoid people may stop using it, or the people that have something to hide(not that you fall into those categories)I think in general most people will not stop using it and others like myself that applaud it, will champion for its use

I believe ultimately this is a good tool. It has the potential for missuse/abuse. The companies who operate as DNA databases should be held to the same quality standards of crime labs if they are to be used in criminal trials. The chain of custody issue is a big deal, doesnt seem like it now, but eventually a defense lawyer is gonna sieze the day, and let a guilty person go free. If someone has something to hide, thats even more reason to ensure things are done legally/ethically, or the evidence might just be inadmissible.

Hypothetical,

If a killer submits his neighbors DNA to private database as HIS OWN DNA, and then leaves his neighbors DNA at a muder scene, the corporate database will show up as his neighbor. This could look really bad for the killers neighbor, and even if they dont send an innocent person to prison, his life will still potentially be destroyed just from being put on trial from murder. It may sound like paranoia, but its entirely plausible. Staging/manipulating crimes scenes is far from new, and this is now another vector in which misinformation can be directly fed to investigators with little to no effort on the criminals part. You can submit DNA to whatever business you want, through the mail, without ever proving your identity. This has huge potential for abuse. Its not a crime, as far as I know, to submit your DNA as mine, to a private corporation, if I legally obtained the same (ie, trash)

The DNA will ultimately be confirmed and cross checked, verified from sample from the suspect. Or will it? Lots of false convictions out there. Lots of false confessions.

Edit: Not to mention, it should be made overwhelming clear to customers who use these DNA analysis services that their DNA will now be cross referenced with criminal evidence and that they consent to it. Its really no different than reading somebody their rights, a concept that mostly everyone is aware of and come to embrace.

Edit…..again….. even the US military, has been recommending for some time now, that military personell DO NOT use private DNA services, as it can potentially exclude you from certain jobs, not to mention be used against you in court.
